Participation Terms and Conditions - Ponytail Project

In consideration of this registration being accepted and my being permitted to participate in the Event, I agree to the following, intending to be legally bound for myself and my heirs, executors and administrators. “Event” means the event or activity for which you are registering and any related events or activities that take place prior to the main event. 

  1. I understand and agree that I participate in the Event at my own risk.

  2. I acknowledge my participation in the Event may involve a significant degree of physical exertion and risk, including the risk of physical injury and I voluntarily agree to assume those risks. I accept that Cancer Council Queensland has undertaken no assessment of my ability to participate, and I am solely responsible for assessing my level of fitness and ability to participate.  

  3. I agree to adhere to all public health rules and regulations notified to me by my local, state or federal Government, other regulatory body or the Event venue. 

  4. If I am registering for the Event on behalf of a group, as the team captain, I am responsible for knowing the contact details of all attendees in my group. In the event I am contacted directly by the Government (including a government health department) for the purposes of contact tracing, I must: 

    (a) make the contact details of my group available to the Government (if I have the consent of each group member to do so); or 
    (b) contact each member of my group, and request that they provide their contact details to the Government directly.  

  5. I commit to stopping the spread of COVID-19. If at the time of the Event, I am feeling unwell or am subject to a self-quarantine or self-isolation period, I agree not to attend the event. 

  6. I agree to follow the rules, regulations and instructions of the organisers and Cancer Council Queensland.

  7. I understand and accept that the organisers and Cancer Council Queensland are not responsible for any loss or damage to personal belongings and that vehicles are parked at the owner’s own risk.

  8. To the fullest extent permitted by law, I waive any and all rights that I or any other person claiming through me may have, against Cancer Council Queensland, its directors, employees and agents, and I release Cancer Council Queensland, its directors, employees and agents from any and all claims, actions, proceedings and demands arising in relation to any injury (including death), property damage, consequential loss and any other loss, that is suffered by me or any person claiming through me, as a direct or indirect result of any act or omission by me, or my participation in the Event, regardless of whether such loss arises under statute or in tort including the negligence of Cancer Council Queensland or otherwise.

  9. To the fullest extent permitted by law, I will indemnify and keep indemnified Cancer Council Queensland, its directors, employees and agents against any claim or proceeding that is made, threatened or commenced, including for consequential loss and loss of profits and including legal costs on a full indemnity basis, that Cancer Council Queensland, its employees or agents incur or suffer as a direct or indirect result of any act or omission by me, or my participation in the Event.

  10. To the fullest extent permitted by law, Cancer Council Queensland and the organisers exclude all warranties or guarantees regarding the Event including any warranty or guarantee that any services will be rendered with due care and skill or that any goods supplied in connection with those services will be reasonably fit for the purpose for which they are supplied.  To the extent that liability for any warranty or guarantee cannot by law be excluded, then, to the fullest extent permitted by law, Cancer Council Queensland's and the organisers’ liability:

    (a) for death, physical or mental injury or disease (including any aggravation or acceleration of such injury or disease) is entirely excluded; and
    (b) otherwise is limited, at Cancer Council Queensland's option, to supplying the goods or services again or paying the cost of having the goods or services supplied again.

  11. I agree to Cancer Council Queensland and any of its assignees or licensees from time to time using my name, image and/or performance in the Event for any purpose (including publicity, merchandising, editorial, education and fundraising) in any country and by any form of media without qualification (e.g. newspapers, magazines, other print publications, radio and television broadcasts, websites, webinars, podcasts and vodcasts) in perpetuity.

  12. If any provision in this document is unenforceable, illegal or void, then the parties agree that the provision must be read down the minimum necessary to allow it to be enforceable whilst preserving as close as is possible the purpose of the provision.  If the provision cannot be read down, it is severed, and the rest of this document remains in force.

  13. Registration payments are not refundable for any reason. If a participant is unable or unwilling to participate in the Event, or if the Event is modified or terminated for any reason, registration payments will be deemed to be donations to Cancer Council Queensland for which a tax-deductible receipt will be issued upon request.  However, Cancer Council Queensland is willing to consider requests to transfer registration fees to future events on a case by case basis.

    Participants under the age of 18 are required to have a parent or guardian read and accept these terms and conditions of entry on their behalf.


Terms and Conditions for CCQ Competitions and Raffles
 in Queensland

The name of this competition is Ponytail Project 2024 Register and Win

  1. The promoter of this competition is Cancer Council Queensland, Address: 553 Gregory Terrace, Fortitude Valley, QLD 4006, ABN: 48 321 126 727.  Cancer Council Queensland is a registered charity under the Collections Act 1966 (Qld) and with the Australian Charities and Not-for-profits Commission. 

    ELIGIBILITY 

  2. To be eligible to enter this competition entrants must: 
    a) Register to fundraise for Cancer Council Queensland via Ponytail Project 2024 through https://www.ponytailproject.com.au/ before Wednesday, 31 January 2024 at 11:59PM AEST. 
    .  
  3. Entering this competition is deemed acceptance of these Terms and Conditions. Entrants under the age of 18 are required to have a parent or guardian read and accept these Terms and Conditions on their behalf. 
  4. Cancer Council Queensland reserves the right to invalidate any entry which it considers to be in breach of these Terms and Conditions. 
  5. If, for any reason, the competition is prevented or hindered from being conducted as planned, including, but not limited to, due to tampering, unauthorised intervention, fraud, technical failures or acts of God, Cancer Council Queensland reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available to it, and to cancel, terminate, modify or suspend the competition. 
  6. Cancer Council Queensland reserves the right to disqualify any contestant at any time in its absolute discretion.  
  7. Cancer Council Queensland employees and directors, and their relatives are ineligible to enter.  
  8. The start date of the competition is: Friday, 1 December 2023 at 12:00AM AEST.  
  9. Entries close: Wednesday, 31 January 2024 at 11:59PM AEST. 
  10. The prize will be drawn: at 2:00PM AEST on Monday, 5 February 2024 at Cancer Council Queensland, 553 Gregory Terrace, Fortitude Valley, QLD 4006. 
  11. The competition is open to Queensland residents only.

  12. There is only one prize winner.

  14. Terms and conditions of the prize: 
    a) Register to fundraise for Cancer Council Queensland via Ponytail Project 2024 through https://www.ponytailproject.com.au/ before Wednesday, 31 January 2024 at 11:59PM AEST. 
    b)Competition closes at 11:59PM AEST, Wednesday, 31 January 2024. 
  15. The prize will be awarded at random to the participant who has registered to fundraise for Cancer Council Queensland via Ponytail Project 2024 through https://www.ponytailproject.com.au/ between 12:00AM AEST, Friday, 1 December 2023 and 11:59PM AEST Wednesday, 31 January 2024. 
  16. The prize is not transferable and cannot be exchanged for cash.  
  17. Cancer Council Queensland’s decision is final, and it will not enter into correspondence regarding the result.  
  18. The winner will be notified by phone, email, or SMS, using the contact details on the winner’s registration within 28 days of the drawing date. 
  19. Prize winners have until 10:00AM AEST, Monday, 4 March 2024 to claim the prize.  
  20. Cancer Council Queensland will deliver the prize to the winner within 1 month of the winner being announced.  
  21. The name of the winner will published after the participant accepts their prize on the Ponytail Project Instagram. 
  22. If Cancer Council Queensland is unable to contact the prize winner by 10:00AM AEST, Monday, 4 March 2024, an unclaimed prize draw will be held at 10:30AM AEST, Monday, 4 March 2024, at Cancer Council Queensland, 553 Gregory Terrace, Fortitude Valley, QLD 4006. The redraw winner will be notified by phone, email, or SMS, using the contact details provided in the participants registration 
  23. Cancer Council Queensland and its members accept no responsibility for late, lost or misdirected mail.  
  24. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify Cancer Council Queensland.  A request to access or modify any information provided in an entry should be directed to Cancer Council Queensland.  

    EXCLUSION OF LIABILITY AND INDEMNIFICATION 

  25. To the fullest extent permitted by law, entrants waive any and all rights that they or any other person claiming through them may have, against Cancer Council Queensland, its directors, employees and agents, and they release Cancer Council Queensland, its directors, employees and agents from any and all claims, actions, proceedings and demands arising in relation to any injury (including death), property damage, consequential loss and any other loss, that is suffered by them or any person claiming through them as a direct or indirect result of their participation in the competition, regardless of whether such loss arises under statute or in tort including the negligence of Cancer Council Queensland or otherwise.

    MEDIA CONSENT AND PRIVACY

By winning this prize the winner agrees to participate in and co-operate as required with all reasonable Cancer Council Queensland and media editorial requests relating to the prize, including but not limited to, being interviewed and photographed and/or filmed. The winner agrees to Cancer Council Queensland from time to time using their name, image and/or performance in this competition for any purpose (including publicity, merchandising, editorial, education and fundraising) in any country and by any form of media without qualification (e.g. newspapers, magazines, other print publications, radio and television broadcasts, websites, podcasts, and vodcasts) in perpetuity.  
  29. Entrants’ personal information will be collected by Cancer Council Queensland so that it can contact each prize winner. Cancer Council Queensland may use an Entrant’s information to send them information about programs, products, services, fundraising or other activities which it thinks may interest them.
